EXTENSION OF EXECUTABILITY
The following terms and conditions are accepted as the sole basis of any kind of
business relations between the customer and D&T Mailorder in the consisting form
at the point of stating an order. Deviating conditions by the customer will not
be accepted by D&T Mailorder as long as there hasn�t been sent any written consent
by any executive in charge concerning a change to any point of terms and conditions.
All orders are subject to our terms and conditions.
By ordering any of our product you accept the sole juridical rightfulness of our terms and conditions.
Any change to any term needs our exclusive written consent.
FORWARDING EXPENSES

RESELLERS REQUESTS:
Basically we are
open for any requests by resellers! Nevertheless D&T Mailorder reserves the right to NOT
to deliver any stock to any reseller without giving any reason for doing so!
DELIVERY, DELIVERY TIME, PARTIAL DELIVERY:
Normally deliveries
are being processed the same day they have been placed - delivery of items in stock
starts with two workdays normally! Exceptions from this are days, when the company
is not working as announced by us in our regular news!
Delivery within Austria (sole maildelivery) normally takes 1
-2 workdays
Delivery to Germany (sole maildelivery) can take 4 - 10 workdays!
D&T Mailorder is entitled to send out partial deliveries. These have to be
accepted by the customer
When a partial delivery happens 1) written notice will be found on the bill of the first delivery
2) with a subsequent delivery only the items value will be billed, no further delivery rates! (Exceptions are
Preorders of soon to be released items (see also Presale))
Is there no info to be found on the bill, no subsequent delivery will occur!
Should you want any not delivered item, you have to order it anew!
Subsequent deliveries are also possible on expressly demand by the customer!
In this case a delivery rate will be billed !
All mentioned delivery times or release dates are without obligation because they
cannot be influenced by us.

Special offers
and sell off items are delivered only as long as there is stock of these items!
These items are listet seperately or marked with "Abverkauf" !
Delivery only as long as the stock is enough - therefor items which are not
deliverable anymore don�t figure in the order value!
D&T Mailorder reserves itself to retire from the bill of sale
when orders exceed the amount of items on stock!
D&T Mailorder reserves the right to resell "sell off" items at a
higher price after the end of a sell off period.
FORUM ACTIONS / PRICE LOWERING:
NO promotion prices or price lowering can be claimed retrospectively!

COMPLAINTS,
RIGHT OF RETURN:
The danger
changes over to the customer, as soon as the delivery has left D&T Mailorder,
even when subsequent deliveries are being processed.
Data concerning the term of delivery are subject to change, as far as a
term of delivery hasn�t been exceptionally obligingly promised .
We guarantee that product leaves our warehouse free of visible defects.
We are not liable for the talent of the product for a certain use purpose.
The customer has to examine the product promptly after delivery for faultiness.
With entitled defects rebuke we undertake ourselves to finishing touches, substitute delivery or
Contract resignation according to our choice.
The delivered product remains property of the firm D&T Mailorder up to entire
payment. If the packaging is externally damaged at delivery,
the acceptance should be refused with a tip to the postman.
Exchange is possible only by wrong delivery or production mistakes.
With complaints that do not result from a defect of the product,
the product must be provided as it was it by delivery, originally wielded together,
or show the intact quality-seal.
"I don�t like it" is not accepted as argument!!!!!!!
You must complain to damage on the transport within 48 hours, because, otherwise,
the claim to free substitute will extinct.
If you should receive a faulty DVD from us, please contact us first
via email under dtm@dtm.at . You will receive a return number from us,
which must be stated on the outside of the parcel clearly written!
With the return, we need a precise description of the mistake with detailed
mistake information! The original packaging must exist. Wrong deliveries
on account of missing information (picture format or sound format etc.)
count as a retoure of taste and cannot be exchanged therefore. By no means
do not send back product without previous consultation with us.
We generally refuse the acceptance of postage unpaid sendings.

Non-acceptance of a delivery:
If the acceptance of a delivery is refused, the customer will be billed the postage costs
and, in addition, any costs resulted will be taken into account, however, at least
15.00 Euros. Our right on fulfilment of the bill of sale remains untouched from this.
D&T Mailorder expressly reserves the right to exclude the relevant customer from
certain payment possibilities in the future, after refusal of a cash on delivery order.

lack to be represented by D&T Mailorder of the before purchased article,
D&T Mailorder is entitled to the defects removal or to the substitute
delivery according to its own own choice.
If D&T Mailorder is not ready for the defects removal or substitute delivery
or not in the position or the defects removal delayed out of adequate
Terms for reasons which D&T Mailorder has to represent,
or if the defects removal or substitute delivery hits fails for any
other reason to be represented by D&T Mailorder, the customer
is entitled to withdraw from the contract
or to require a suitable decrease of the purchase price,
according to his own choice. As far as subsequently nothing else arises,
any further claims of the customer - equally for which legal reasons
- are impossible.
D&T Mailorder therefore, is not liable for any damages that might
have occured outside of the object of delivery itself; in particular
D&T Mailorder is not liable for escaped profit or for any other
property damages of the customer.As far as the liability by
D&T Mailorder is excluded or is limited, this also counts for
the personal liability of employees, representatives
and fulfilment assistants of D&T Mailorder.
DATA SECURITY:
All necessary data
concerning the processing of orders and/or inquieries are being
stored to our electronic data base and will not be forwarded to
any third person.
The customer expressly agrees to be informed about news and sales
actions by D&T Mailorder up to recant by the customer. The customer also agrees
to renounce on any legal action against information free of charge!
Each of our newsletter contains an "unsubscribe" function !
The customer can unsubscribe at any time after he has
received an information free of charge!
The customer consents expressly to this raising, processing and use of person
related data .
SPAM :
D&T Mailorder supports NO SPAM policy!
Therefor every newsletter contains an "unsubscribe" function! If somebody
should have put you on our list without your consent please take advantage
of this possibility!
APPLICABLE
LAW AND LEGAL VENUE:
Applicable law is
Austrian law exclusively. Exclusive legal venue for all claims in
connection with a business relation is Neud�rfl.

legal venue.
SALVATORIC CLAUSE:
If a regulation
in these terms of business or a regulation within the scope of any other
Arrangements should be ineffective or become ineffective, this will not
touch the effectiveness of all other regulations or arrangements.
Should one of the preceding regulations be ineffective or become ineffective, this will
not touch the effectiveness of the remaining regulations .
In place of the ineffective regulation an effective regulation will stand on behalf,
which comes next to the sense and the economic purpose of the ineffective regulation.
ADDITIONS:
Additions to
the Terms and Conditions can be extended sensiblily at any time or changed
subsequent to actual, up-to date, juridical and/or economical terms .
